New Bankruptcy Rules 2016

From 1 April 2016, the Federal Court (Bankruptcy) Rules 2016 will replace the current Federal Court (Bankruptcy) Rules 2005 and the Federal Circuit Court (Bankruptcy) Rules 2016 will replace the current Federal Circuit Court (Bankruptcy) Rules 2006. The new Bankruptcy Rules rewrite the existing rules in the contemporary drafting style using consistent terminology with the Bankruptcy Act 1966. The new Rules also correct obvious errors and provide guidance where required. New approved forms will complement the new rules.  The existing forms will have a grace period of six months to allow for precedent system changes.

More information about the change is available on the Federal Court of Australia’s website and the Federal Circuit Court of Australia’s website.
