Family Court of Australia – Changes to Application for Consent Orders Kit

UPDATE – NOTICE TO LEGAL PRACTITIONERS

The Family Court of Australia’s Application for Consent Orders Kit information pages have been updated as a result of the Civil Law and Justice Legislation Amendment Act 2018.

References to the terms ‘husband’ and ‘wife’ have also been amended to ‘party to a marriage’ and/or ‘party to a de facto relationship’.

A change has also been made to the form within the kit at Q15, updating the reference to section 90XZA of the Family Law Act.

The updated kit and form are now available on the website.

The Court recommends using the new ‘unguided’ upload method to eFile an Application for Consent Orders, however the grace period outlined in the email of 24 December 2018 (below) has been extended until 31 March 2019  for the ‘guided’ eFiling option to allow for IT system changes.

Information about eFiling and the ‘unguided’ process is available at www.familycourt.gov.au/dcp and details on how to apply for consent orders are available on the website at www.familycourt.gov.au/howdoi
