The Justices of the High Court have issued the following Practice Direction No 1 of 2019 dealing with legislation and authorities for appeals and other Full Court matters.
Paragraph 3 of the Practice Direction requires each party and intervener to provide as an annexure to their Written Submissions a list of the particular legislative provisions referred to in the submissions identifying the correct version of the legislation as at the date or dates relevant to the case. This will assist the Court to identify the correct version of the relevant legislative provisions in advance of the filing of the Joint Book of Authorities.
Joint Book of Authorities
In anticipation of the introduction of electronic filing of documents in the High Court the Justices have altered the structure of the Joint Book of Authorities (“JBA”) and removed the requirement to file and serve hard copies of the JBA in appeals and other Full Court matters. Commencing with matters set down for hearing after 1 October 2019 the new Practice Direction requires the appellant to file and serve the electronic version only of the JBA.
