Family Violence and Cross-Examination of Parties Scheme – Legal Aid Board- Guidelines

The Ban on the direct cross-examination of parties in certain Family Law proceedings commenced on 10 September.

The Legal Aid Board has approved the Family Violence and Cross-Examination of Parties Scheme Guidelines, and a Work Items and Fee Schedule (available on our website here and here).

The Guidelines draw from the existing guidelines but provide a separate framework for dealing with these matters. Practitioners undertaking this work as asked to familiarise themselves with the Guidelines and associated documents.

We have also prepared a Lawyer Information sheet (available here), which explains how the Scheme works and covers topics such as how to apply under the Scheme and file management.

Lawyers must be on the Register of Practitioners to apply for assistance under the Scheme. A list of lawyers on the Register is available here.
