Justice Benjamin appointed to the Commission of Inquiry into Tasmanian Government’s Responses to Child Sexual Abuse in Institutional Settings

One of the Family Court of Australia’s most experienced and well-respected judges, the Hon Robert Benjamin AM, was yesterday announced as a Commissioner to assist the Inquiry into Tasmanian Government’s Responses to Child Sexual Abuse in Institutional Settings.

The Inquiry will be led by The Hon. Marcia Neave a former Justice of Appeal of the Victorian Supreme Court and who was Royal Commissioner in Victoria’s recent family violence inquiry. 

The other Commissioner is Professor Leah Bromfield, a Co-Director of the Australian Centre for Child Protection at the University of South Australia.

Following nearly 16 years serving the Tasmanian community as a judge of the Family Court, Justice Benjamin will officially retire from the Court on 21 May 2021. 

He was made a Member of the Order of Australia for significant service to the judiciary and to the law, legal education, mediation, arbitration and to professional standards. He was also, until last year, a Presidential Member of the Australian Administrative Appeals Tribunal.

Prior to appointment to the Court, Justice Benjamin was in private practice for thirty years, almost exclusively in family law. In 2003, Justice Benjamin was President of the Law Society New South Wales and had chaired its Family Law Committee for many years.

As part of HH’s commission to the Inquiry, he will spend the next 12 to 18 months taking evidence and preparing a report for the Tasmanian Government. As Justice Benjamin’s appointment is part-time he will also undertake additional mediation and arbitration work in mainland Australia following his retirement from the Court.
