The Guardianship and Administration Amendment Regulations 2024 were officially notified in the Gazette on 27 August 2024.

These amendments introduce several changes to the Guardianship and Administration Regulations 2017, including:

  1. The removal of definitions for “health care professional” and “psychologist” from the interpretation section.
  2. Replacement of Part 2 (Applications under the Act), updating supporting report and declaration requirements.
    A penalty is also introduced for health practitioners or qualified experts who submit reports assessing the decision-making ability of a close family member.
  3. The inclusion of speech pathologists as prescribed health practitioners under Part 5A of the Act.
  4. The introduction of new complaint processes for the Public Guardian and the Public Trustee, which must align with Australian Standard 10002 Guidelines for complaint management in organisations.

These regulations will take effect upon the commencement of the Guardianship and Administration Amendment Act 2023, on 1 September 2024.
