7/5/2019 | President – ABC on-line interview with Ellen Coulter re 194K of the Evidence Act. The Society welcomes law reform opportunities and community and stakeholder engagement is important. The proposed changes clarify the law and the process of dealing with applications under the Evidence Act. The Act is designed to protect the identity of the complainant and the fact defendants are not identified is to ensure complainants are not identified by inference. |

30/4/2019 | President was interviewed by ABC TV News re Labor’s policy on sentencing of sex offenders. The society is vehemently opposed to mandatory sentencing and notes that the Sentencing Advisory Council and the Law Council of Australia are also opposed to it. Increasing maximum penalties is a legitimate way of informing courts of parliaments view of the objective seriousness of a crime. Life imprisonment is not the current penalty for these particular crimes. There is already an upward trend in sentencing for these crimes as noted by the Sentencing Advisory Council report from November 2018 so the need for any change is questionable. |

The Society cautions against drawing conclusions from a single month’s statistics as there are fluctuations over time. Difficult to say if there is an increase in the courts because the courts are already extremely busy. Lawyers make a significant difference to the efficiency of the courts and assist in rehabilitation of offenders by putting them in touch with services. |

The society declined to comment on the Sue Neil Fraser case however the Criminal Code does not exclude a subsequent appeal in the light of fresh and compelling evidence. It may be difficult to secure leave for a third appeal etc given the requirements of the act however. |
12/3/2019 | President spok to ABC Radio with Leon Compton re power of citizen’s arrest. Best to leave arrest to the police who are professionally trained. While there is a power to arrest under sec 55 of the code any one utilising it places themselves at physical risk and risk of being charged themselves. |

To change the laws would require a unified approach across jurisdictions. Non-publication orders are still a very important tool despite on-line publication. |

8/3/2019 | President spoke to Damien McIntyre ABC News on Purchasers obtaining tests to see if the property has been used for methamphetamine production. Said would be governed by the terms of the contract whether purchaser has a remedy. These issues highlight why lawyers should be used in conveyancing as experts in the law. Many complexities can arise and when they do lawyers are best placed to deal with those issues. |

7/3/2019 | President spoke to Fairfax re proposed one punch laws and re-affirmed our opposition to the introduction of a new law. There is no need for a new crime as existing laws and sentencing powers adequately cover these cases. We are opposed to any mandatory sentencing measure as they create unjust outcomes. The laws in NSW involved a series of measures including lock-out laws and liquor restrictions so the effectiveness of the one punch laws in NSW is difficult to assess. |
26/2/2019 | President was contacted by the Advocate and discussed the following Northern Prison: Confirmed our support for a northern prison including access to prisoner and opportunity to keep prisoners connected in to their families. The location is not of particular concern to us. Lawyer X – Lawyers in Tas hold themselves to very high standards and clients can be confident of the professionalism and confidentiality of lawyers in this state.Law Reform Institute review of fitness and psych defences. We look forward to being involved in this review. We see a need to consider whether the act are functioning as intended. |

28/1/2019 | President spoke to the Examiner. Issue: backlog Supreme Court Comment: Support re-appointment of temporary judges however need for more broad reaching reforms. Will work with Govt on that. We see the funding issue as crucial to delay issue and feds are part of the problem. Pointed them to the LCA and justice project. Gave detailed comment on effect, cause and answer with respect to delay. |
28/1/2019 | President spoke to ABC News (TV) Issue: Workplaces (protection from protesters) Amendment Bill. Comment: that original act was flawed and we said that at the time of its introduction. The HC held a number of sections to be inconsistent with the constitution in the decision of Brown v Tas. The amendments seek to address that but they are sweeping. Hard to say of still unconstitutional yet. We say should not be indictable, note that penalties have been significantly reduced. Will be part of consultation process and we welcome the opportunity. |
