This session is designed for intermediate to advanced legal practitioners involved in land acquisition matters. It will begin with a brief overview of the legal process, then delve into the practical challenges that arise when legislation meets real-world application. Key topics include types of acquisitions (including easements and partial takings), acting for both private and government clients, briefing valuers, compensation principles, and voluntary acquisitions under the Land Acquisition Act.

- Legal process overview – from initial instructions through to negotiations and final resolution.
- Legislation vs practice – highlighting where practical realities diverge from statutory procedures.
- Types of acquisitions – not just freehold but also easements and partial acquisitions.
- Acting for different parties – both private individuals and acquiring authorities should be addressed, though the latter presents greater complexity.
- Valuation issues. An overview of: Role of valuers and what lawyers need to brief them on; Different valuation methods and when each is appropriate; Compensation for loss of income (e.g. partial acquisition of agricultural/commercial land).
- Voluntary acquisitions – cover acquisition by agreement under the Land Acquisition Act.

Clare Wootton, Senior Associate, Simmons Wolfhagen
About the Presenter:
Clare Wootton is a Senior Associate at Simmons Wolfhagen and is a key member of both the Local Government, Planning & Development team and the Property and Commercial Law team Clare is highly specialised in property matters relating to both individuals and local government. She has a particular interest in historical land investigations, access issues, dedication of land, reserve roads and notations on land titles and providing advice in relation to the issues that arise within these areas. In addition, Clare has extensive expertise in providing advice and assistance to clients with complex property law matters including the implementation of subdivisions, easements and covenants, as well as conveyancing matters, contract preparation and advice.
Aidan Cameron-Smith, Head Valuer, Office of the Valuer-General
About the Presenter:
Aidan Cameron-Smith, Head Valuer at Office of the Valuer-General, commenced at the Office of the Valuer-General in 2007. Since completing his undergraduate degree and achieving AAPI CPV certification, he has worked across Tasmania, gaining extensive experience in valuing a wide range of asset classes. This broad expertise has been a key strength in his role as the Senior Valuer responsible for undertaking compensation assessments for compulsory acquisitions in Tasmania since 2022.
Joe Stansfield, Director and Property Valuer, Acumentis
About the Presenter:
Joe Stansfield is a property valuer with a background and interest in property standards and how standards frameworks and the valuation profession help to underpin the domestic and international economy. He has previously been an owner of a small, independent valuation firm within Tasmania and is now a Regional Director at Acumentis (an ASX Listed Valuation Firm). Joe has been involved in valuation and standards for 15-years and is a current member of the International Valuation Standards Council (IVSC) Advisory Forum and Australian Property Institute (API) Standards Steering Committee. He has also previously been a Non-Executive Director of the API.
Elana Salter, Acquisition Program Manager, Office of the Valuer-General
About the Presenter:
Elana Salter works in the Office of the Valuer-General as the Acquisition Program Manager. Elana is responsible for ensuring compliance with the Land Acquisition Act 1993 and managing all compulsory land acquisitions undertaken by the Crown. Elana has extensive expertise in providing land acquisition advice to the Crown and assisting with compensation negotiations.
