Podcast Takeaways

  • Prioritise informal restructuring where possible. Informal tools such as pre-packs, stakeholder engagement and negotiated arrangements can deliver faster, more flexible outcomes than formal processes, and should be considered early before external administration becomes unavoidable.
  • Use restructuring tools creatively and strategically. Personal guarantees, deeds of assignment and deeds of novation, often avoided in standard advice, can be effective negotiating tools when carefully structured to address creditor concerns and support viable restructuring outcomes. Engage early and constructively with the ATO. Understanding ATO administrative processes, required forms and enforcement options is critical. Early engagement, including consideration of security arrangements such as second mortgages, can support payment plans and reduce director exposure to personal tax liabilities.
  • Support directors through safe harbour with clarity and candour. Successful safe harbour relies on open, honest discussions with directors about their obligations, the mechanics of the regime, and realistic plans to restore business viability while managing ongoing risks.
