SUBJECT: APPROVED FORMS – PRELIMINARY NOTICE
The Recorder of Titles is implementing clauses 9, 10 and 11 of the Recorder’s Directions by approving new forms to:
- provide certifications on the face of the forms;
- provide for Signer(s) to sign the form; and
- remove current witnessing requirements.
The first forms to be approved are the Transfer, Mortgage, and Discharge of Mortgage and a consolidation of existing forms which provide for a change of name.
Approvals to print will also be cancelled as the approved forms become available via the Tasmania Online Land Dealings (TOLD) system. Separate communications are being provided to affected parties.
There will be a transition period where the previously approved forms and approval to print forms will still be accepted for lodgement. Dates of the applicable transition period for each approved form will be communicated in due course.
As forms are approved, the process provided for in section 169A of the Land Titles Act 1980 will be followed whereby notice is provided of: the forms being approved; and the date upon which they become effective. The remaining relevant forms will be approved incrementally.
