SUBJECT: CLARIFICATION – VARYING DATES ON REGISTRY INSTRUMENTS

It is acknowledged that when a Registry Instrument (RI) created in TOLD is subsequently re-printed within TOLD (whether amended or not) the ‘Created’ date in the footer changes. This can lead to circumstances where the Land Titles Office (LTO) receives multi-page RI’s with different ‘Created’ dates.

The LTO will make no enquiries where some or all pages of a Registry Instrument (RI) have different ‘Created’ dates except:

  1. Where the first page of an RI has a ‘Created’ date later than: any of the Execution Dates on that RI, or the Date of the RI; or
  2. Where the Date or Execution Date of a Registry Instrument is earlier than its ‘Created’ date.

In such cases, the LTO may request an explanation by way of a Lodgement Enquiry (for which there is no fee).

Prior to lodgement it remains a matter for the parties to ensure that the whole of the RI has been approved and accepted by or on behalf of those parties.

Execution Date

There is no requirement for the Execution Dates on a Registry Instrument to be identical e.g. a Signer for a Transferor can sign on a different day to the Signer for a Transferee.
