SUBJECT: CONVEYANCING REFORM IN TASMANIA: REMOVAL OF CERTIFICATES OF TITLE
Certificates of title will be removed 1 September 2026
(subject only to any variation necessitated as a consequence of circumstances currently unforeseen).
Current Status of Certificates of Title
Certificates of title remain part of the conveyancing process in Tasmania – whether using the paper-based or electronic processes.
Registry Instruments associated with a conveyancing transaction, lodged with the Land Titles Office (LTO) for registration, must generally be accompanied by:
(i) The relevant paper certificates of title; or
(ii) The appropriate production slip receipt – obtained by supplying to the LTO the relevant paper certificate(s) of title in advance; or
(iii) The appropriate production slip receipt – obtained by the virtual production of the relevant ‘held on behalf of’ (HOBO) certificate(s) of title using the Tasmania Online Land Dealings (TOLD) system.
Electronic conveyancing is available in Tasmania and also requires prior production of relevant certificates of title in accordance with paragraphs (ii) or (iii) above.
Work is continuing regarding the dependencies (listed over the page) for the removal of certificates of title.
A decision to remove certificates of title will only take place when all of the following dependencies have been satisfactorily resolved:
(a) All of the implications of such removal have been evaluated and addressed;
(b) Registry Instruments and other Documents have been amended and subsequently been in use for a sufficient period of time (after allowing for transition arrangements); and
(c) There is sufficient evidence from Compliance Examinations undertaken, demonstrating the requisite standard of compliance with the Recorder’s Directions.
Some detail about the above dependencies is provided in Attachment 1.
Announcement
With the above in mind, certificates of title will be removed 1 September 2026 (subject only to any variation necessitated as a consequence of circumstances currently unforeseen).
As previously published there will be not less than 3 months’ notice of the removal of certificates of title, that is to say a further communication will be issued no later than 1 June 2026 providing updated information.
The removal will be for all certificate of titles (excluding general law titles) on one nominated date.
