Compliance Examinations
Compliance examination continues across paper-based lodgements and is commencing for electronic lodgements.
Feedback has been provided to a substantial number of Subscriber organisations by way of discussion sessions. These have occurred between June and September 2024 and have included to date some 57 legal and conveyancing firms. The sessions covered an overview of the requirements and process, common difficulties observed, items to consider and information about Compliance Examinations undertaken including for the particular Subscriber. Also provided was an update of the reform of the conveyancing process including progress towards electronic conveyancing and the intended removal of certificates of title. Those Subscribers who accepted the offer of a session have largely reported how beneficial the session was to their understanding of the requirements and process. This increased understanding has also been observed in the quality of more recently received responses. Certificates of Title
Certificates of title remain part of the conveyancing process in Tasmania. The LTO is however working to implement reforms which will facilitate the eventual removal of certificates of title from the process and will provide appropriate notice of this occurring.

Electronic Conveyancing
The National Electronic Conveyancing System is now available in Tasmania. Mortgage and discharge of mortgage transactions are now available to lodge electronically. In order to lodge Registry Instruments and other Documents using electronic conveyancing, it is necessary to first become a Subscriber to an Electronic Lodgment Network. PEXA (Property Exchange Australia) is currently the only ELNO approved to operate an Electronic Lodgment Network in Tasmania.
The LTO in conjunction with the State Revenue Office and PEXA are currently working on implementing functionality to enable transfers of land in Tasmania, which is scheduled for introduction in February 2025. The LTO will provide relevant updates (including via the LTO’s website) as this work progresses.
