SUBJECT: CLARIFICATION – SPECIFICATION OF SIGNER ROLE
Where either an approved form, or form approved by the Recorder, requires a Signer to sign, the role of the Signer must also be specified (Signer Role).
Each Signer Role available to be selected when preparing a Registry Instrument on TOLD is a shortened form of each relevant Signer as defined in the Directions issued by the Recorder of Titles (Directions). For the avoidance of doubt it is reiterated that such shortened form of the Signer Role appearing in TOLD is not the complete definition of that Signer Role.
Version 1 of the Directions is effective 7 March 2024 – 12 April 2026 inclusive.
Directions Version 1 provides the definition of ‘Signer’.
Signer means:
(a) an Australian Legal Practitioner; or
(b) a Licensed Conveyancer; or
(c) an Officer or employee of an ADI
who is a Principal, Officer, employee, agent or contractor of, and authorised by the Subscriber to sign Registry Instruments and other Documents, on behalf of the Subscriber; or
(d) any Person required by statute to sign the Registry Instrument or other Document; or
(e) an Officer or employee of the Crown with the appropriate delegated authority to sign the Registry Instrument or other Document.
To comply with Version 1 of the Directions, the only acceptable Signer Roles available to be selected when preparing a Registry Instrument on TOLD (and using the corresponding paragraph lettering above) are:
(a) Australian Legal Practitioner; or
(b) Licensed Conveyancer; or
(c) Officer or Employee authorised by the ADI; or
(d) Person required by statute; or
(e) Employee of the Crown with appropriate delegated authority.
Version 2 of the Directions is effective 13 April 2026.
Directions Version 2 provides the definition of ‘Signer’.
Signer means:
(a) an Australian Legal Practitioner who is a principal, Officer, employee, agent or contractor of the Subscriber, and is authorised by, such Subscriber to sign Registry Instruments and other Documents, on behalf of such Subscriber; or
(b) a Licensed Conveyancer who is a principal, Officer, employee, agent or contractor of the Subscriber, and is authorised by, such Subscriber to sign Registry Instruments and other Documents, on behalf of such Subscriber; or
(c) a principal, Officer or employee of the Subscriber where the Subscriber is an ADI and such principal, Officer or employee is authorised by such Subscriber to sign Registry Instruments and other Documents, on behalf of such Subscriber; or
(d) for the purposes of a Mortgage, Discharge of Mortgage, or Partial Discharge of Mortgage only, an attorney of the Subscriber duly appointed pursuant to the Powers of Attorney Act 2000 (TAS) as amended from time to time, provided that such:
i. Subscriber is an ADI;
ii. attorney is authorised by the Subscriber to sign such documents on behalf of the Subscriber; and
iii. attorney declares in the attestation clause of any such document that such attorney has not received notice of revocation of the power contained in the relevant power of attorney.
(e) any Person required by statute to sign the Registry Instrument or other Document; or
(f) an Officer or employee of the Crown with the appropriate authority to sign the Registry Instrument or other Document.
To comply with Version 2 of the Directions, the only acceptable Signer Roles available to be selected when preparing a Registry Instrument on TOLD (and using the corresponding paragraph lettering above) are:
(a) Australian Legal Practitioner; or
(b) Licensed Conveyancer; or
(c) principal, Officer or employee of an ADI; or
(d) attorney of an ADI duly appointed pursuant to the Powers of Attorney Act 2000; or
(e) Person required by statute; or
(f) Officer or employee of the Crown with appropriate authority.
Notes
Note 1: [Applicable to Versions 1 and 2 of the Directions] Any variation to the acceptable Signer Roles listed above may result in a requisition of the Registry Instrument. Care must be taken especially when inserting the Signer Role by hand after the Registry Instrument has been generated; the wording must replicate exactly a choice available on TOLD. For example, it is not acceptable to substitute Australian Legal Practitioner with: Lawyer, Solicitor or Legal Practitioner.
Note 2: [Applicable to Versions 1 and 2 of the Directions] Any alterations required to be made to a Signer Role may be made, initialled and dated by that Signer or by a person on behalf of that Signer only in accordance with Regulation 15(3).
Note 3: [Applicable to Version 2 of the Directions] When the Signer Role “attorney of an ADI duly appointed pursuant to the Powers of Attorney Act 2000” is selected, the required declaration – that such attorney has not received notice of revocation of the power contained in the relevant power of attorney – will populate when the form is generated. A Registry Instrument without the required declaration will result in a requisition.
