SUBJECT: STRATA TITLES ACT 1998 – REQUIREMENTS FOR CONSENT
This email correspondence provides a reminder regarding consents required pursuant to the Strata Titles Act 1998.
Any legislated consent required under the Strata Titles Act 1998 must be lodged with the Recorder of Titles with the relevant application. The following sections of the Strata Titles Act 1998 require written consent from all registered mortgagees of lots –
- Section 17 – Change of unit entitlements;
- Section 19 – Application for amendment;
- Section 23 – Application for consolidation; and
- Section 27 – Application for cancellation.
The Directions issued by the Recorder of Titles version 3 (Directions) also require Consent to be provided for strata plans.
It is noted that from 1 September 2026 paper certificate of titles will not be lodged with any Registry Instruments or other Documents with the Recorder of Titles, however, any legislated consent and any Consent required by the Directions should be lodged with the Recorder of Titles.
