The Australian Government is seeking expressions of interest from suitably qualified individuals to be considered for nomination to the pool of arbitrators for the partial recomposition of the Multi-Party Interim Appeal Arbitration Arrangement (MPIA).

To be considered for selection as Australia’s nominated candidate, applicants must:

  • hold Australian citizenship (dual nationals accepted);
  • be a person “of recognized authority, with demonstrated expertise in law, international trade and the subject matter of the covered agreements generally” (paragraph 4 of the MPIA text and paragraph 3 of Annex 2 of the MPIA text);
  • be unaffiliated with any government (paragraph 4 of the MPIA text),
  • be willing to comply with the Rules of conduct for the understanding on rules and procedures governing the settlement of disputes and the Agreed Procedures for Arbitration under Article 25 of the DSU in Annex 1 of the MPIA.

Suitably qualified individuals wishing to be considered for Australia’s nomination to the MPIA pool of arbitrators should complete the below DFAT template CV and email it, together with an expression of interest of no more than 400 words, to Trade.Law@dfat.gov.au by 1100 AEST Monday, 30 September 2024.

Individuals deemed suitable for nomination will be subject to a vetting process prior to nomination. Nomination as Australia’s candidate does not guarantee appointment to the MPIA pool of arbitrators.

All candidates nominated by participating WTO Members participating in the MPIA will undergo a pre-selection process carried out by a pre-selection committee composed of the WTO Director General, the Chairperson of the WTO Dispute Settlement Body, and the Chairpersons of the Goods, Services, TRIPS and General Councils.
