Understanding Your Brain: A Practical Guide for Legal Professionals

Lawyers are trained to interpret legislation, construct arguments, and manage complexity under pressure. But there’s one tool underpinning every clause, case, and client interaction that rarely gets any formal attention: the brain. It’s the control centre of your career, yet most professionals have never been taught how it works, what it needs, or how to support it.

Understanding the brain isn’t just interesting. It’s strategic. It allows you to work with your biology, not against it. And when the stakes are high, that edge matters.

What follows is an excerpt from a neuroscience-based session I have delivered for The Law Society of Tasmania and to lawyers across Australia. It’s designed to translate current brain science into insights and practical strategies.

This article is a practical invitation: to get curious about the organ that does the thinking, arguing, empathising, and remembering. The more you understand your brain, the more you can influence how you think, feel, and work, so let’s cover four key principles of brain function.

Mental health is physical brain health
Let’s start with a big idea: mental health is brain health. It isn’t some abstract emotional state that floats above the body, it’s rooted in the physical condition and function of your brain.


Your moods, motivation, focus, and emotional control all depend on the brain’s biology: its chemistry, structure, and electrical activity. When the brain is supported, those capacities thrive. But when it’s under strain, through poor sleep, chronic stress, illness, or disconnection, it can falter.

We’re used to servicing our cars, upgrading our phones, and running system checks on software. But the brain? We usually wait until things are falling apart before paying attention. By that point, it’s often harder (though not impossible) to recalibrate.

The takeaway here is simple. Looking after your brain is not indulgent. It’s not even optional. It’s professional maintenance.

The brain has the capacity for change
One of the most powerful discoveries in neuroscience over the past few decades is that the brain remains plastic throughout life, we call this neuroplasticity. This isn’t the kind of plastic that litters oceans, but rather, plastic in the sense of being malleable, changeable and adaptable with use.

Every time you practise a skill, repeat a thought, or respond to a challenge, you’re activating specific neural pathways. The more they’re used, the stronger they get. Like a well-worn trail through grass, repetition makes that route the brain’s preferred shortcut.

This is why habits feel automatic. It’s also why change can feel difficult at first: you’re asking your brain to carve a new path through unfamiliar territory. But with consistency, that new path becomes smoother, faster, and eventually second nature.

Neuroplasticity means you are not stuck. If you find yourself falling into the same unhelpful patterns, overthinking, snapping at colleagues, or procrastinating, it’s not because you’re broken. It’s because that particular neural route is familiar. I’d like you to take a moment to reflect on which neural pathways (behaviours, thoughts or reactions) you are unintentionally giving power to. Because with intention and repetition, we can rewire our brain to better serve us.

The brain always tries to save energy
Your brain makes up only about 2% of your body weight, yet it consumes roughly 20% of your energy. That’s a hungry organ. To stay efficient, the brain has evolved to constantly look for ways to conserve fuel. This is because during our evolution we didn’t always have unlimited access to food/energy, like we do now. So the brain found many ways to reduce energy use, and still does this by creating habits which automate common behaviours, allowing it default to the path of least resistance.

This has obvious upsides, imagine having to consciously think through how to brush your teeth every morning. But it also means that when you’re tired, under pressure, or juggling competing demands, your brain is likely to revert to easy defaults: refreshing your inbox instead of drafting that difficult advice, zoning out in a meeting, or reacting rather than responding.

It’s not laziness. It’s biology.

Understanding this helps reframe those moments of drift or resistance. It also gives you a way to work smarter. By building routines and environments that align with your goals, like scheduling deep work during your freshest hours, or putting your phone out of reach, you reduce the need for willpower. You let the brain’s love of efficiency work in your favour.

Most neural processing is subconscious
Here’s another surprising fact: the majority of your brain’s activity happens outside conscious awareness and control. Some estimates suggest that up to 90% of what the brain does is subconscious. That includes the regulation of body systems, but also patterns of thought, emotion, and behaviour.

This is why we can feel “off” without knowing why, or find ourselves in the middle of a reaction before our rational brain has caught up. It’s not always a matter of control. Often, it’s a matter of wiring.

This isn’t bad news, it’s a design feature. Your subconscious brain is fast, efficient, and able to process a myriad of complex cues in the background while you focus on other things. But when left unchecked, it can also run the show in ways that don’t serve us.

The antidote is awareness. When you learn to notice your own thought loops, behavioural triggers, or emotional patterns, you create a small window to choose differently. Even a brief pause between stimulus and response can begin to shift the circuitry. One practical and evidence-based way to train our control over our awareness is through mindfulness meditation. And because you know about neuroplasticity, you know that even though it’s staying focused in the present moment can be hard in the beginning, it will get easier and become your default with time.

That time you dedicate to mental training is the beginning of agency.

Why this matters for legal professionals
So what does all of this have to do with your work in the law?

Everything.

Your brain determines how well you concentrate in court, how clearly you think under pressure, how effectively you listen to clients, and how resilient you are in the face of setbacks. It shapes your ability to empathise, regulate your mood, handle ethical dilemmas, and find creative solutions.

Legal work is cognitively and emotionally demanding. It requires sustained attention, complex reasoning, and interpersonal nuance. That means brain health isn’t just a wellness topic. It’s a performance metric.

Understanding your brain gives you practical tools. It lets you spot when your system is overloaded. It helps you create conditions for clarity and focus. It empowers you to shift out of unhelpful patterns. And ultimately, it enables you to practise law in a way that is more effective and sustainable, for your clients, your firm, and yourself.
